Kie To Care Privacy Policy
1. Purpose
The purpose of this Privacy Policy is to ensure all Protected Health Information (PHI) and
personally identifiable information (PII) of clients and employees served by Kie To Care is
handled in a confidential, secure, and lawful manner in compliance with the Health Insurance
Portability and Accountability Act (HIPAA), 55 Pa. Code Chapter 15, and other applicable
state and federal privacy laws.
2. Scope
This policy applies to all employees, contractors, and representatives of Kie To Care who have
access to client or employee information.
3. Information We Collect
We collect and maintain information necessary to deliver care and operate our agency, including
but not limited to:
Name, address, date of birth, phone number
Health history, diagnoses, medications
Emergency contact details
Insurance, financial, and billing records
Visit logs, care documentation, service authorizations
Employee data (background checks, TB/physical results, training records)
4. Use and Disclosure of PHI
Kie To Care may use or disclose PHI for the following purposes:
Treatment: Coordinating or managing care with providers, hospitals, and therapists
Payment: Billing Medicaid, Managed Care Organizations (MCOs), VA, and other
insurers
Operations: Quality reviews, audits, training, scheduling, and complianceWe will not disclose any client or employee information without written authorization
unless required by law or for emergency situations.
5. Confidentiality Requirements for Staff
All employees must sign a confidentiality agreement upon hire
Employees may only access records necessary to perform their duties
Sharing or discussing client information outside of the agency or with unauthorized
persons is strictly prohibited
All caregivers and administrative staff must complete HIPAA training annually
Any violation of this policy may result in disciplinary action up to and including
termination
6. Data Security & Safeguards
Electronic data is stored in secure, password-protected platforms
Paper files are kept in locked cabinets with restricted access
All devices used for work purposes must be protected by passcodes
Only authorized personnel may access PHI and client documentation
Regular audits and monitoring of access are performed
7. Client Rights
Clients or their authorized representatives have the right to:
Access and review their records
Request corrections to inaccuracies
Request restrictions on certain uses/disclosures
Receive a copy of this Privacy Policy
File a complaint if they believe their privacy has been violated
8. Breach Notification
In the event of a breach involving PHI or PII, Kie To Care will:
Notify the affected individual(s) in writing within 60 calendar days
Inform the Department of Human Services (DHS) and other authorities, if applicable
Investigate and document the incident
Take corrective actions and implement safeguards to prevent future breaches9. Retention of Records
All client and employee records, including documentation related to privacy concerns or
disclosures, will be retained for a minimum of 5 years in accordance with Pennsylvania
regulations.
10. Policy Availability & Training
This Privacy Policy will be:
Provided to all clients upon intake and to employees during onboarding
Included in the Client Welcome Packet and Employee Handbook
Reviewed annually and updated as needed
Accompanied by annual privacy training for all staff
